1. Acceptance of Terms

By downloading, installing, or using the Vigilant Ear mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Vigilant Ear is an assistive application designed to provide real-time acoustic awareness and directional guidance for Deaf and hard-of-hearing individuals. The App uses your device’s microphone, sensors, and (where you grant permission) location, camera, and related system services to detect sounds (such as sirens, alarms, knocks, and vehicles), estimate approximate direction and distance, show them on a map or radar, deliver optional alerts (including to Apple Watch or Live Activities where available), and — when enabled — provide on-device live captions and optional translation. Optional paid features (Power Pack+, a one-time unlock with a free trial, not a subscription) may add capabilities such as automatic translation, multi-device Constellation mesh, and music identification; free core features remain available without purchase.

3. Important Safety Disclaimer

Vigilant Ear is an assistive tool only. It is not a replacement for:

Typical visual awareness
Professional hearing assistance
Emergency services
Your own judgement

The App may not detect all sounds, and directional estimates are approximate. Always use your own visual confirmation and judgement. Never rely solely on this App for your safety.

4. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vigilant Ear, ITS DEVELOPERS, AND ITS PARENT COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF PROFITS, DATA LOSS, OR ANY OTHER DAMAGES ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

6. User Responsibilities

You agree to:

Use the App responsibly and in accordance with all applicable laws
Not rely on the App as your sole means of situational awareness
Keep the App updated to the latest version
Report any bugs or issues you encounter

7. Intellectual Property

All content, design, code, and trademarks in the App are owned by Wingdings, Inc. or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the App without prior written permission.

8. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for any reason.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the Effective Date above. Your continued use of the App after such changes constitutes acceptance of the new Terms.
